What is Accident Reconstruction?

In a nutshell, accident reconstruction is a scientific examination of not only how an accident happened, but also why it happened. If an insurance company fails to offer you a fair settlement, and you choose to take the case to court, an accident reconstruction could be used to convince the court the accident wasn’t your fault, and that you’re entitled to much more money than the insurer is willing to pay.

How Does Accident Reconstruction Work?

The accident reconstruction expert in your case will look at a wide variety of factors that contributed to the wreck. They then use several different types of information in order to determine how the accident took place.

First, the expert may look at the police report to obtain certain facts. For example, the time and date the accident took place, the location of the wreck, and the makes and models of all the vehicles involved. Then experts will also look for other information, such as statements from witnesses as well as the drivers, if they’re available.

Other evidence will be taken into account as well, such as any photographs or videos taken at the scene, the positions of the vehicles after impact occurred, and road and weather conditions when the accident occurred.

This and more information will then be inputted into a special program that can simulate the accident. Reconstruction specialists may also run experiments. They may alter different possible speeds of the vehicles, as well as the angles at which they were traveling, until the simulation is in line with the physical evidence that was recovered.

In most instances, the expert will provide an animated presentation that will give their opinion on how the accident took place. This presentation could be shown to a judge and/or a jury. These animations are typically very compelling – helping show that parties other than the victim are to blame for the accident.

Will Accident Reconstruction Help to Prove Negligence?

In order to be able to win your case, you’ll need to be able to show that the driver of the truck – or some other party – caused the accident through negligence. Accident reconstruction could help you do just that. It will analyze each and every component of the accident. So it may be able to show, for instance, whether the truck driver applied the brakes at an appropriate time. It could show that the truck driver was speeding, or was weaving due to being impaired.

If that reconstruction helps establish negligence, you may be able to pursue compensation for the following types of damages:

  • Medical bills can show not only the extent of your injury, as well as the expenses you’ve incurred. These can include hospital and rehabilitation bills, but also money you’ve spent having to go to and from doctor’s appointments. Medical bills can also involve any types of devices you’ve had to use, such as a wheelchair or crutches, as well as in-home care that might have been required.

Include the specific number of days you’ve had to miss work, the amount of wages you’ve lost (and expect to lose), sick days or vacation days you’ve lost, and your pay rate and number of hours worked during the typical workweek.
